Code of Criminal Procedure, 1973–Secs. 216 & 217–Alteration in charge –Legal aspects–Held, in case of alteration/addition of charge causes any prejudice, in any way of the accused, there must be a fresh trial on the said altered/new charges and for this purpose, the prosecution may also be given an opportunity to recall witnesses as required u/s. 217 Cr.PC.
