Rajasthan Panchayati Raj Act, 1994–Sec. 38(4)–Suspension of sarpanch on the ground of pendency of criminal case–Two requisite conditions–Either the enquiry should have been initiated prior to passing the order of suspension or the criminal proceedings should be pending at the stage of trial–Trial can be held pending only when the charge have been framed–None of condition was fulfilled before passing the impugned orders–Quashed and set aside.
