Code of Civil Procedure, 1908–Order 39, Rules 1 & 2–Rejection of application–Patta issued in favour of respondent is old than the patta issued in favour of petitioner–Respondents also submitted the electricity bill pertaining to the land in question–Description of land mentioned in the patta of the petitioner is not found matched–Petitioner submitted the patta along with the map of Balwant Market regarding the shop, but the said patta is residential and the map was not issued by the competent authority–As per the report of Commissioner, description of the land was matched with the patta submitted by the respondent–No prima facie case in favour of petitioner–Further, the balance of convenience is also not his favour–Furthermore, the order of injunction would cause the irreparable injury to the respondents–Held, application was rightly dismissed.
