Rajasthan Land Revenue (Conversion of Agricultural Land for Non-Agricultural Purposes in Rural Areas) Rules, 1992–National Highways Act, 1956–Land Acquisition Act, 1899–Sec. 5–Compensation–Denial from granting–As per amendment in the Rule 4 of Rules, 1992, the prohibitory limit of 20 feet from the center/middle of the road was increased 100 feet–But the land of the petitioner had already been converted prior to amendment–Respondents were not right in treating the land of the petitioner to be a non-converted land–Ground of delay raised by the respondents also cannot be accepted as the physical possession of land has not been taken till date–Petitioner is permitted to move an appropriate application.
