Carriage by Road Act, 2007–Sec. 16–Code of Civil Procedure, 1908–Order 7, Rule 11–Prayer for rejection of plaint–Dismissed–Suit for claiming the compensation which was paid to consignee–Sec. 16 of the Carriage by Road Act, 2007 provides that before the institution of the suit or legal proceedings, it is necessary to serve a notice of demand in writing–No document is available to comply with the provisions of Sec. 16–Held, the suit cannot be instituted in view of the bar contained u/s. 16–Application under Order 7, Rule 11 deserves to be allowed.
