Transfer of Property Act, 1882–Sec. 53-A–Specific Relief Act, 1963–Sec. 16–Possession of a prospective purchaser–Protection–Availability–Plaintiff purchased the property from it’s original owner and filed the suit for eviction–Sitting tenant come with the case that he was having possession on the ground of agreement of sale between the original owner and him–Plaintiff was not aware of this fact–Evidence available on record are revealing that the tenant was never ready and willful to perform his part of contract–He was not entitled for specific performance of sale agreement–Therefore, his possession cannot be protected u/s. 53-A of T.P. Act.
