Rajasthan Premises (Control of Rent & Eviction) Act, 1950–Sec. 13(1)(e)–Subletting–Lease deed was executed in favour of R & S for their partnership firm–D was found running business on the premise that the tenanted property came in his share in partition of joint hindu family–Lease deed no where revealing that the property was rented to joint hindu family–Clause in lease deed that if a new person is inducted as a partner by way of partnership deed, it would not be deemed subletting–However, D neither entered in premises by way of a new partner not by successor of original tenants–Clear case of subletting–Decree of eviction deserves to be granted.
