Specific Relief Act, 1963–Sec. 10–Scope for granting the decree of specific performance–Discretionary powers of Court–Even if two factors of valid agreement and readyness & willingness are satisfied, it being a discretionary relief, the same can be refused and the money or advance can be directed to be refunded back instead of directing a transfer of property under such agreement.
