Code of Civil Procedure, 1908–Order 39, Rules 1 & 2–Order of granting temporary injunction–Sustainability–Suit for partition–Trial Court restrained the petitioners from evicting the plaintiff from the portion of property in which she is living–Further, the petitioners were restricted from any change, new construction or alination of suit property–Order of restraining from eviction does not require any modification–However, remaining portion of impugned order deserves to be vacated.
