Code of Civil Procedure, 1908–Sec. 148–Rajasthan Rent Control Act, 2001–Sec. 9–Order of eviction–Writ petition against–High Court disposed the writ petition with certain directions–Appellant failed to deposit the arrears of rent within time–He filed two applications for extension of time for deposit and to condone the delay–Dismissal–Justification–Though there was delay in depositing the arrear of rent but subsequently the deposits were made in execution–This fact was not adverted by High Court while rejecting the applications–Direction was upto effect that the liability to pay three time rent shall accrue after the six months from the date of issue of certificate of re-possession was issued–There was no material on record as to when the certificate was issued–Further, the orders passed by Tribunals were superseded by the order of High Court and directions of High Court were required to be adhered and not the orders of Tribunals–Impugned order of High Court set aside and directed to put the appellant in possession of premises.
