Code of Civil Procedure, 1908–Order 6, Rule 14–Application for amendment in written statement–Dismissal of–Suit for cancellation of sale deed and permanent injunction–Defendant sought to incorporate the incident of 2nd and 3rd June, 2016 regarding which the FIR was lodged–This fact was not brought to the notice of Court for a year–Plaintiff’s evidence had been closed and defendant had filed the affidavit in evidence without adverting this incident–He failed to explain the inordinate delay–Further, the trial Court was of view that that the fact sought to be taken on record was irrelevant–Held, application was rightly dismissed.
