Penal Code, 1860–Secs. 406, 420 & 120-B [Corresponding Secs. 316(2), 318(4) & 61(2) of BNS, 2023]–Criminal proceedings–Sustainability–FIR as well as the factual report does not disclose that the accused-persons had an intention to deceive the complainant from the very inception, i.e. at the time of execution of the agreement for local distributorship between the parties–Subsequently, some dispute arose between the parties and required goods were not supplied by the accused-persons to the complainant–Factual report shows that the husband of complainant has received the amount of Rs. 2,96,000/- way back in the year 2018–No offence is made out in the instant case–Co-accused who has not approached before this Court, is equally entitled to the relief, granted to the petitioner–FIR and proceedings quashed.
