Bharatiya Nagarik Suraksha Sanhita, 2023–Sec. 430 [Corresponding Sec. 389 of Cr.P.C., 1973]–Protection of Children from Sexual Offences Act, 2012–Sec. 3/4 (2)–Bharatiya Nyaya Sanhita, 2023–Secs. 351 & 332(b)–Prayer for suspension of sentence–The reasons for maintaining silence and not promptly reporting the alleged incident of sexual abuse on the very day when the applicant was apprehended at the spot is a matter that requires critical examination by this Court while exercising its appellate jurisdiction–All the issues raised are vital in nature and carry sufficient force and substance, such that if these are adjudicated in favour of the appellant, the possibility of acquittal canot be ruled out–Application deserves to be allowed subject to certain conditions.
