Bharatiya Sakshya Adhiniyam, 2023–Sec. 60 [Corresponding Sec. 65 of Evidence Act, 1872]–Negotiable Instruments Act, 1881–Sec. 138–Trial Court declined to take the copy of FIR on record on the ground that the petitioner failed to explain its necessity for the just decision of the case–Justification–Petitioner has taken the stand that the cheque issued to complainant was relatable to a fixed deposit of Bhavishya Credit Co-operative Society and not in discharge of any legally enforceable debt–Petitioner ought to be afforded an opportunity to lead evidence in support of his defence–Petitioner is directed to submit the document before the Trial Court.
