Civil Procedure–Cross-examination of party–The cross-examination of the defendant no. 1 was taken as ‘Nil’ on the ground that he has failed to file the written statement in the stipulated time–Reason given is absolutely perverse and is contrary to the right of defence available to the defendant–The purpose of cross-examination is to elicit the truth from the witnesses and impeach its credibility–When the defendant has not filed the written statement, his right to cross-examine the plaintiff’s witnesses is not foreclosed–Impugned order is liable to be set aside.
