Specific Relief Act, 1963–Sec. 12–Ground of the defendants that their signatures for receipt of amount were obtained on a blank paper–Acceptability–D1 & D2 had admitted their signatures on the page carrying the endorsement of receipt of Rs. 1,95,000/- –A presumption would arise that it was endorsed for a good consideration–A heavy burden lays on D1 & D2 to explain the circumstances in which their signatures appeared that, particularly when the endorsement was on the back of registered document–First Appellate Court rightly rejected the plea of defendants–High Court ought not to have interfered with the findings of fact returned by the First Appellate Court.
