Possession, Permanent Injunction & Mesne Profit–Suit for–Decreed–Appellant herself admitted that she signed the Ex. 6 and received the amount of Rs. ten lakh through the cheque–She admitted the facts of going to registry office and signatures of witnesses on the sale deed–She also admitted the possession–DW 2 also admitted these facts–She also admitted that there is no documentary evidence to show that the suit property was kept mortgaged– Appellant admitted that the rent of Rs. 10,000/- per month can be received, if only groundfloor of the house is rented–She failed to file the affidavit in support of the written statement, therefore, the objection of Court Fees is not sustainable–Held, suit was rightly decreed.
