Hindu Marriage Act, 1955–Secs. 13 & 19–Code of Civil Procedure, 1908–Order 7, Rule 11–Rejection of divorce petition under the provisions of Order 7, Rule 11–In the petition u/s. 13, the petitioner made specific averments that after she was thrown out from her matrimonial home, she took shelter with her parents–In the reply of application under Order 7, Rule 11 she admitted that she has been temporarily residing in Ahemdabed on account of her temporary nature of employment–The pleadings of the reply of the application do not clearly make out an admission–If the pleadings in the reply gives some ambiguity as regard to the residence contrary to specific and clear pleadings in the petition, the same can be explained at an appropriate stage–Trial Court ought not have rejected the petition–Impugned order is liable to be set aside.
