Juvenile Justice (Care & Protection of Children) Act, 2000–Penal Code, 1860–Secs. 376 & 342–Sentence of five years R.I.–Plea of the appellant that he was juvenile on the date of offence–Procedure has been followed as provided under the Act of 2000 and the 2007 Rules–The findings with regard to his age at the time of commission of the offence has been returned as 16 years 2 months and 2 days–Appellant was a juvenile on the date of commission of the crime–Sentence as imposed by the Trial Court and upheld by the High Court is set aside and matter is referred to Board for passing appropriate order.
