Penal Code, 1860–Secs. 306 & 498A [Corresponding Secs. 108 & 85 of BNS, 2023]–Order of framing the charge–Sustainability–Deceased levelled the allegations that the counsel of the petitioner asked her frivolous and uncomfortable questions in cross-examination of a case and the petitioner levelled false allegations against her–She further stated that she was in mental tension due to the fact that the petitioner-husband had left her in destitute for last twelve years and married somebody else–No evidence to show that the accused meted out the deceased with any cruelty to bring home the offence punishable u/s. 498A–It has also not been shown that what were the words uttered or what was the act which instigated the abetment of suicide–Held, impugned order of framing charge is liable to be quashed and set aside.
