Code of Criminal Procedure, 1973–Sec. 438 [Corresponding Sec. 482 of BNSS, 2023]–Penal Code, 1860–Secs. 195A, 294 & 506–Order of granting the anticipatory bail–Challenged with the contention that the respondent-accused is a habitual offender–High Court considered the facts and circumstances of the case including the allegations–Alleged offences are triable by Judicial Magistrate, First Class–None of the offences would carry sentence of more than seven years–Respondent is already in jail in connection with other offence–High Court has elaborately dealt with the case–Declined to interfere with the order–However, the respondent is directed to report to the concerned police station on 1st or 2nd day of every month, if he is released on bail in other cases.
