Udaipur Development Authority Act, 2023–Sec. 32–Notice for removal of illegal construction–As per provisions of Section, notice must be issued to the owner and not to the family members–Non-compliance of Sec. 32 of the Act–Impugned order of removal and consequential notice are liable to be quashed and set aside on this only ground–However, the notice issued to family members of the petitioners shall be treated as the notice to the petitioners and liberty is given to them to raise all the grounds available to them under the law.
