Code of Civil Procedure, 1908–Order 7, Rule 11 & Sec. 9–Companies Act, 2013–Sec. 244(1)–Prayer for rejection of plaint–Dismissal of–Plaintiff was one of the total ten members of the company–He was entitled to move an application u/s. 244(1) of the Companies Act–Impugned order, passed by the Trial Court is contrary to the provisions–Plaint deserves to be rejected–Plaintiff would be liberty to pray for return of the plaint or to move the appropriate forum in terms of the law.
