Code of Criminal Procedure, 1973–Sec. 195(1) [Corresponding Sec. 215 of BNSS, 2023]–Complaint has to be filed before the Court taking cognizance and it can be before a Judicial Magistrate and not before an Executive Magistrate who does not has the power to take cognizance of an offence or try such cases.
