Hindu Minority & Guardianship Act, 1956–Secs. 6 & 13–Constitution of India, 1950–Art. 226–Issuance of writ of Habeas Corpus for granting the custody of child–Respondent-father is only natural guardian of the minor child and having the legal right to claim the custody–Child being a minor aged of 1.5 years cannot express its intelligent preferences–Merely because the appellants had to take care the child for some time, they cannot retain the custody of child–It is not the case of appellant that the respondent-father is unfit to take care the child except contending that there is no female support to take care of the child–Impugned judgment of High Court deserves to be confirmed with certain observations.
