Penal Code, 1860–Secs. 302 & 148–Conviction–Plea of appellant that the eye-witnesses are closely related to the deceased–Acceptability–No material contradictions or omissons have been brought on record in their cross-examination–If the evidence of an eye-witness who is a close relative of deceased is cognet, reliable and credible, it can be relied upon–Accused nos. 1 to 4 & 11 were known to eye-witnesses–There was a recovery of hunting sickles at the instance of accused nos. 1 to 4 and these were found stained with human blood–No delay in lodging the complaint–Medical evidence up to effect that the injuries could be caused by hunting sickles–Held, conviction was justified.
