Penal Code, 1860–Secs. 307, 323, 341, 147 & 148–Code of Criminal Procedure, 1973–Sec. 482–Prayer for quashing the FIR–No specific allegation against the petitioner in the FIR–Investigation Officer has not collected the cogent evidence that the petitioner played active role in the criminal conspiracy that was hatched between V & F–None of witnesses have stated regarding the role of petitioner in so-called conspiracy–Petitioner was in Jaipur at the time of incident–If the FIR registered against the petitioner is allowed, it would be failure of justice and abuse of process of the law–FIR qua the petitioner deserves to be quashed.
