Indian Partnership Act, 1932–Sec. 42(c)–View of Single Bench that the suit for dissolution of partnership firm and rendition of accounts was barred by the limitation–It is not disputed that B was the partner of the firm and he expired in the year 1984–Question of limitation in the instant case is a pure question of law and not a mixed question of fact and law–The firm stood automatically dissolved in the year 1984 as mandated u/s. 42(c) of the Act unless there was a contract between remaining partners of the firms to the contrary–Suit could have been filed within three years but it was filed in the year 1996 which was clearly barred–Impugned judgment passed by the Division Bench deserves to be reversed and set aside.
