Rajasthan Land Revenue Act, 1956–Sec. 82–Reference–Allowed by BOR–Order set aside by Single Bench–Earlier, the application seeking reference was rejected by the Settlement Commissioner way back on 07.11.1983–Thereafter, the Addl.Collector had no jurisdiction and authority in grab of Sec. 82 to reinitiate the reference proceedings–The order passed by the Settlement Commissioner in earlier reference, right or wrong was binding on the Addl. Collector –Further, it was confirmed by BOR and nothing was left to be touched upon by the Addl. Collector in respect of the same land–Once, certain proceedings have attained finality, without challenging the orders passed earlier, it was certainly not open to reopen the whole proceedings by conveniently avoiding the earlier order.
