Cancellation of Sale Deed–Suit for–Dismissal of–Allegation that the sale deed was got executed by taking undue advantage of the old age of the plaintiff and he was taken to Bharatpur under the pretext of his eye-examination–No averment in the plaint that the plaintiff was not subjected to eye-examination on that day–No specific pleadings of fraud as required under the provisions of Order 6, Rule 4–Conclusion of trial Court that the plaintiff was in a fit mental state when the sale deed was executed–Endorsement of Registrar over the sale deed that the plaintiff has admitted as regard to receipt of sale consideration –He failed to rebut the presumption u/s. 58 of the Registration Act–Plaintiff himself had written the letter to Sub-Registrar, Bayana on which the direction was issued to Sub-Registrar, Bharatpur for execution of the sale deed–Held, the suit was rightly dismissed.
