Code of Criminal Procedure, 1973–Sec. 452–Release of machinery in favour of complainant–Justification–Contract between the parties as regards to a mine–Co-ordinate Bench of this Court has quashed the FIR and subsequent proceedings–Order attained finality–Anything which was done during the investigation has to be reverted back to a situation assuming that such action was never taken place–Memo of seizure shows that the machinery/equipments were seized from M/s. New Bhagwati Minerals–Order of disposal was passed as it was interim disposal–Property was to be released in term of Sec. 452 in favour of the person from whom it was seized–There was no occasion to enquiry regarding best entitlement or registered ownership of the equipment/ property–Direction issued accordingly.
