Code of Civil Procedure, 1908–Order 7, Rule 11–Rajasthan Court Fees & Suit valuation Act, 1961–Sec. 35(2)–Application for rejection of plaint–Dismissal of–Suit for partition–Suit has been made as per Sec. 35(2) and there is no dispute about that valuation–Whether valuing of the relief of declaration in respect of three documents i.e. gift deed, sale deed and decree of rent Tribunal, which is obviously ancillary in nature, can be permitted at once or should be made separately, the petitioner-defendent is at liberty to raise his objection in the written statement–Interference declined.
