Penal Code, 1860–Secs. 376, 313 & 120-B–FIR for the offence–Sustainability–Complainant is a major lady–She went with the petitioner at various places not only in India but also abroad–Physical relations were established in the Year 2015 and FIR was lodged in the year 2019–She was well knowing that the petitioner was a married person–It cannot be said that the sexual relations were on false promise of marriage–Respondent was the consented party–FIR is liable to be quashed.
