Rajasthan Rent Control Act, 2001–Sec. 9–Dismissal of eviction petition by appellate Tribunal–Justification–Rent for 56 months was not paid–View of both Tribunals that the notice does not mention the default of four months, is found illegal and unjustified–Further, the personal and bona fide necessity is seen on the day when the eviction petition is moved and not on the date when the premises was given out on rent–Wrong interpretation of legal provisions–Matter deserves to be remanded back to Tribunal for passing the appropriate order.
