Rajasthan Municipalities Act, 2009–Sec. 39(6)–Order of suspension–Sustainability–Basis of impugned order was issuance of charge sheet and preliminary report–FIR was not the ground for taking such action–In the inquiry report, no definite opinion was given as regard to involvement of petitioner–It does not reflect the application of mind by the inquiry officer–No finding up to effect that the explanations furnished by the petitioner were found to be unsatisfactory–Petitioner was placed under suspension in a routine manner, rather, in colourable exercise of powers without appreciating and analysing the gravity of charges–Impugned order deserves to be quashed and set aside.
