Insecticides Act, 1968–Secs. 33, 17, 18 & 29–Offence by Company–Cognizance–Appellant no. 2 has furnished the undertaking indicating that M was the Manager of Company and he was in-charge of and responsible to the Company to maintain the quality of the pesticides manufactured–Company had passed the resolution fixing the responsibility on him–Prosecution cannot be allowed against the appellant no. 2 on the basis of vague and spacious plea that he was the Managing Director of the Company at the relevant time–Proceedings qua the appellant no. 2 are liable to be quashed.
