Code of Civil Procedure, 1908–Order 47, Rule 1–Review–Decree of eviction–In the second appeal, while recording the findings pertaining to the ownership of the suit property, relying on the statements of PW 1, a major part of the statement, which would have implication in relation to the findings as recorded, got omitted–Apparent error on the face of record–In the suit for eviction, the law is settled against the determination of property–Order recalled up to the limited extent wherein the findings have been recorded pertaining to the title/ownership of the suit property.
