Penal Code, 1860–Sec. 396–Conviction–Sustainability–Evidence of test identification parade is completely unreliable–Further, the admission of PW-4 that the accuseds were shown in the police station–Sufficient to demolish the prosecution case in regards to identification parade–No corroboration is coming forward to the test identification carried by the Magistrate–When the prosecution failed to establish the identity of accuseds, recovery effected from the already acquitted accuseds cannot be held proved–Appellants are acquitted from the charge of the offence.
