Code of Criminal Procedure, 1973–Sec. 301–Trial Court permitted to the appellant to be heard along with the public prosecutor on the basis of oral prayer–View of High Court that the role of the complainant is limited u/s. 301 Cr.P.C and he cannot be allowed to take over the prosecution by directly addressing the Court–If the complainant wants to take advantage as provided u/s. 302, he should file a written application–Held, such liberty of filing application is granted to appellant-complainant.
