Penal Code, 1860–Sec. 302/149–Conviction–Sustainability–High Court disbelieved the testimony of G qua the other co-accused’s but accepted the same for convicting the appellants–View of High Court that the injuries caused by appellants are corroborated by post mortem report–No discussion with a corresponding finding that the post mortem report does not corroborate injuries attributed to other co-accused’s–Testimony of sole eye witness was found rightly unreliable–Appellants are entitled to claim the parity with other coaccused’s–Conviction set aside.
