Prevention of Corruption Act, 1988–Secs. 13(1)(d) r/w 13(2)–Code of Criminal Procedure, 1973–Sec. 227–Order of discharge–Set aside by High Court–Justification–Allegation that the conspiracy was hatched between certain public servants and owners of lands for giving undue advantage to them–Agreements relied upon by prosecution does not bear the signatures of appellants–These were recovered from the custody of vendors–Nothing on record to show that the consideration mentioned in the agreement could be traced to appellants–Further, no statement by any of witness to suggest the meeting of minds between the appellants and other accused–Held, High Court was not justified in setting aside the order of discharge.
