Penal Code, 1860–Secs. 304-B & 498-A–Demand of dowry–Statement of mother of deceased revealing that both the families celebrated all the festivities in the spirit of their customary obligation and both were engaged in offering gifts to each other with the prevailing practice and tradition–Same cannot be termed as dowry–Further, the demand of Rs. 20,000/- was allegedly made before two years of occurrence and during this period, deceased gave birth to a female child–Demand was too remote to the occurrence–Further more, the demand of sewing the machine cannot be termed as demand of dowry because mother of deceased stated that deceased knew tailoring and machine was given to her for tailoring–Held, findings of acquittal were rightly recorded by High Court.
