Penal Code, 1860–Secs. 304-B & 498-A–Conviction–Sustainable against whom ?–Dead body of deceased was cremated hurriedly without informing the parents and relatives of deceased–Strong militating circumstance–Sufficient material on record showing that the deceased was harassed and subjected to cruelty in connection with non-fulfillment of demand of dowry–Held, the conviction was justified–However, evidence on record revealing that J could not have persistently subjected the deceased to dowry harassment and cruelty–He is entitled to be acquitted from the charge u/s. 304-B–Appellants no. 2 & 3 are physically handicapped and they are taking care of the son of the deceased–Extreme penalty of life imprisonment is reduced up to the imprisonment of seven years.
