Penal Code, 1860–Sec. 300–Exception IV–Applicability of provision–Following conditions should be satisfied-
(i) that the incident happened without premeditation,
(ii) in the heat of passion,
(iii) upon a sudden quarrel, and
(v) without the offender taken undue advantage or acted in a cruel or unusual manner.
