Wakf Act, 1995–Secs. 7(5) & 85–Suit for cancellation of sale deed, rent, possession, rendition of accounts, and removal of trustees–Pending at the time when the Act of 1995 came into force–Application for returning of suit–Allowed–Propriety–Some of the issues were falling within the exclusive jurisdiction of civil Court–Further, the suit was filed much before the Act came into force hence the civil Court having to continue jurisdiction–Impugned judgment set aside and civil Court is directed to decide the suit.
