Code of Criminal Procedure, 1973–Sec. 329–Penal Code, 1860–Secs. 302 & 84–Conviction u/s. 302–Accused was suffering from acute/aggravated psychiatric ailment–Trial Court was apprised of this fact but no enquiry was made u/s. 329, Cr.P.C.–He is entitled to the defence of plea of insanity privided by Sec. 84–No such benefit was extended to him–Conviction is liable to be quashed and set aside.
