Code of Civil Procedure, 1908–Order 20, Rule 18–Limitation Act, 1963–Art. 136–Appeal against the execution of decree–Whether it would affect the enforceability of the decree?–Held, unless the appellate Court stays its operation, there would be no effect on the enforceability of decree–However, if the appeal results in a decree that would supersede the decree passed by the lower Court, the decree of appellate Court would become enforceable–If the order of appellate Court does not amount to a decree there would be no supersession and the decree of lower Court will be continued to be enforceable.
