Criminal Trial–Death sentence–Rarest of the rare case for awarding death sentence–It is to be examined with reference to the facts and circumstances of each case and the Court is required to take note of the aggravating and mitigating circumstances–It is to be concluded that what was uncommon about the crime which renders the sentence of life imprisonment inadequate and calls death sentence.
