Code of Civil Procedure, 1908–Secs. 47 & 21–Execution proceedings–Objection upto effect that the decree was passed by the Court which was having no territorial jurisdiction–Whether the objection can be laid before the execution Court ?–Held, no–High Court committed error in comming to conclusion that it was within the jurisdiction of the executing Court to decide whether the decree in suit for partition was passed in absence of territorial jurisdiction.
