Code of Criminal Procedure, 1973–Secs. 389 & 439(2)–Penal Code, 1860–Secs. 302 & 302/34–Prayer for cancellation of suspension of sentence–Accused are continuously indulged in nefarious criminal activities–Though there is no such stipulation in the order of suspension of sentences that the accused will not re-indulge in any other offence while being on bail this condition is inherently entrenched in every bail order–Repeated indulgence invariably leads to an inference that they are misusing the liberty granted by this Court–Applications for cancellation of suspension of sentence are liable to be allowed.
